ARTICLE II. WEEDS
Sec. 11-16. Unlawful to allow growth in excess of ten (10) inches.
It shall be unlawful for the owner, owners, occupant or occupants of real estate within the Town to permit weeds or other vegetation to grow and mature on such real estate to a height in excess of ten (10) inches; provided, however, that this section shall not apply to trees and shrubbery.
Violations of this section shall be included in Appendix B of the
Chesterton Town Code and processed, for the first time offenders, through
the Ordinance Violations Bureau with a fine of $100.00 to be
assessed. Subsequent violations of this section by the violator
shall subject said violator to the General Penalty provision of the
Chesterton Town Code found at Section 1-9.
Sec. 11-17. Notice of violations; correction by Town upon owner or occupant's failure to comply with notice.
The Building Commissioner shall have the authority to determine, from time to time, where violations of this
Article exist. Upon determining that a violation exists, the
Building Commissioner shall all persons with substantial interest in the
property upon which the violation exists that such violation shall be corrected within
ten (10) days after receipt of notice. In the event the violation
is not corrected within that time, the Building Commissioner shall have
the right to have such violation corrected in any manner he deems reasonable and fit.
Sec. 11-18. Collection of costs of correction of violation by Town.
Any cost incurred by the Town in correcting a violation of this article shall be taxed against the offending property owner and placed upon the tax records for collection. |
